Client Data refers to information provided by registered business clients during account creation and platform usage, including name, company name, email address, phone number, billing details, and communication preferences. During the onboarding process, NESARK also collects KYC (Know Your Customer) documents including Business Registration Certificate, Business Owner ID Card, and Business PAN Card, as required for regulatory compliance and account verification. This data is collected directly from the client and is used to manage their account, verify business identity, and deliver services.

End-Recipient Data refers to mobile numbers, message content, and delivery status data that clients upload or transmit through the NESARK platform for the purpose of sending SMS, WhatsApp, RCS, or Voice communications to their customers. NESARK acts only as a technology intermediary for this data and does not use end-recipient data for any purpose beyond message delivery and reporting. Clients are solely responsible for ensuring they have obtained valid consent from their end recipients before using NESARK services to contact them.

Provide, operate, and maintain our website
Improve, personalize, and expand our website
Understand and analyze how you use our website
Develop new products, services, features, and functionality

Log Files

Nesark follows a standard procedure of using log files. These files log visitors when they visit websites. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. In the course of delivering communication services, NESARK transmits message content and recipient data to the following third-party platforms and service providers: Telecom Operators and Aggregators for SMS and Voice delivery across Indian networks, in compliance with TRAI regulations; Meta Platforms Inc. (WhatsApp) for WhatsApp Business API message delivery, governed by Meta's own data and privacy policies; Google LLC for RCS message delivery, governed by Google's privacy framework; and Payment Gateways for processing transactions and billing. These third parties receive only the minimum data necessary to perform the specific service. NESARK does not sell or rent client or end-recipient data to any third party for marketing or advertising purposes.

CCPA Privacy Rights (Do Not Sell My Personal Information)

Under the CCPA, among other rights, California consumers have the right to:

Request that a business disclose the categories and specific pieces of personal data collected about consumers
Request that a business delete any personal data about the consumer that a business has collected
Request that a business that sells a consumer's personal data, not sell the consumer's personal data

Nesark is also committed to aligning with the Digital Personal Data Protection Act (DPDPA), 2023 as it comes into full effect. Users and clients whose data is processed by NESARK are entitled to rights and protections under applicable Indian law, in addition to any other rights mentioned in this policy.

Children's Information

Nesark does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

Data Retention

NESARK retains client account data for the duration of the active account relationship and for a period of 3 years after account closure or expiry, as required for legal and compliance purposes. Message logs, delivery reports, and campaign data are retained for a period of 180 days from the date of transmission, after which they are permanently deleted from our systems. API keys and authentication logs are retained for 90 days. Clients may request early deletion of their data by contacting us at contact us subject to any legal or regulatory retention obligations.
